Dear Stellar MLS,

If my new listing does not have an address, can I market it without putting it in the MLS and avoid violating the NAR® Clear Cooperation Rule?

Dear No Address,

Properties without addresses are not an exception to the Clear Cooperation Rule.

The NAR® Clear Cooperation Rule States:

Within one (1) business day of marketing a property to the public, the listing broker must submit the listing to the MLS for cooperation with other MLS participants. Public marketing includes, but is not limited to, flyers displayed in windows, yard signs, digital marketing on public facing websites, brokerage website displays (including IDX and VOW), digital communications marketing (email blasts), multi-brokerage listing sharing networks, and applications available to the general public. 

Our process for listings being advertised without addresses is the following:

  1. After receiving a report, we monitor new listings daily for the agent who has been reported to see if the property has been listed.
  2. If the reported listing is entered into the MLS within one business day, no fine will be issued.
  3. If the listing is not entered into the MLS within one business day, a fine will be issued the day the listing is entered into the MLS using the date stamp of the original report as supporting documentation.
